("Get Joy & Co.," "we," "us," or "our") recognizes the importance of customer privacy and the need to protect information that users of our website, located at https://getjoyfood.com (the "Website"), provide to us, or that we obtain through other ways of interacting with you (collectively, the "Services"). This Privacy Policy explains our data collection practices, how we may use and disclose that information, the steps we take to keep it secure, your choices regarding our use of this information, and how you can contact us if you have any questions about our privacy practices. We will refer to the personal information we obtain about you as "Your Data." Please read our complete Privacy Policy. Get Joy & Co. will occasionally update this Privacy Policy. When we do, we will also revise the "Last Updated" date at the top of this Privacy Policy.

2. Information We Collect

a) Information you provide to us

We collect information from and about you directly when you provide it to us. This information may be collected when you fill out a form, create an account, place an order, subscribe to a recurring delivery plan, interact with our AI-powered Chat Assistant, respond to customer surveys, or otherwise interact with us, such as through social media. This information may include:

  • Contact information, such as your name, phone number, physical address, and email address;
  • Account information, such as your log-in credentials;
  • Payment information, including credit card or other payment method details (processed by our payment processors — we do not store full payment card numbers on our systems);
  • Information about your purchases and subscriptions, such as the type, amount, frequency, renewal dates, and history of your purchases;
  • Information about your pet, including name, breed, age, weight, dietary preferences, allergies, and health goals;
  • Additional information about how you use our products or services;
  • Comments, questions, and requests you may make;
  • Information about your preferences, such as your preferred methods of communication and the types of products and services in which you are interested;
  • Details of transactions you carry out through the Website and the fulfillment of your orders;
  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us; and
  • Any other information you voluntarily provide.

b) Information collected through our AI-Powered Chat Assistant

We use an AI-powered virtual assistant ("Chat Assistant") to help customers with support inquiries, order lookups, subscription management, and general questions about Get Joy products. When you interact with our Chat Assistant, we may collect:

  • Email address — used to locate your Get Joy account, order history, and subscription details;
  • Phone number — used as an alternative identifier to locate your account and, where you have opted in, to communicate with you regarding your order or subscription;
  • Conversation content — the text of your messages, used to respond to your inquiry and, in aggregate anonymized form, to improve our service.

The Chat Assistant is powered by artificial intelligence and may provide automated responses without human review. For complex, sensitive, or time-critical issues, you may request escalation to a human customer care agent at any time by typing "speak to a human" or by emailing cares@getjoyfood.com.

Conversation logs are retained for up to 12 months to support customer service follow-up and service quality review. After this period, personally identifiable information is deleted or de-identified.

Personal information collected through the Chat Assistant is not sold to third parties. We may share this data with our AI service provider(s) solely to operate the Chat Assistant, under contractual obligations of confidentiality and data security. We do not use Chat Assistant data for targeted advertising.

c) Information we collect automatically

Like most online services, we automatically receive standard technical information when you connect with the Services. We collect this information through browser cookies, pixel tags, web server logs, web beacons, embedded scripts, and similar technologies. These features enable us to personalize your experience with the Services, understand how you use them, maintain a persistent session, and improve and further develop the Services. We collect this information as follows:

  • Web server cookies: A cookie is a small piece of information that is sent by our web server, stored on your device, and used by your web browser to "remember" information about your visit. We use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your device until you delete them) to authenticate users, personalize your experience, analyze which features of the Services you use most frequently, and measure and optimize advertising and promotional effectiveness. If you do not want the Services to place a cookie on your device, you may be able to turn that feature off through your browser settings. However, if you decide not to accept cookies from us, the Services may not function properly.
  • Pixel Tags: Certain Services and websites contain electronic images known as pixel tags (also called web beacons or gifs) that we use to help deliver and recognize cookies on our websites, count users who have visited those websites, and gather usage and performance data. We also include pixels in our emails to tell if you open and act on them.
  • Embedded Scripts: An embedded script is programming code that is designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily downloaded onto your device from our web server or a third-party service provider, is active only while you are connected to the Services, and is deactivated or deleted thereafter.
  • Log files: Like most standard website servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user movement in the aggregate, and gather broad demographic information for aggregate use.
  • Device information: We collect information about the device you use to access or use the Website, including the hardware model, operating system and version, unique device identifiers, network information, and information about your use of our applications.
  • Geolocation information: We may automatically collect geolocation information from your device, your wireless carrier, or certain third-party service providers ("Geolocation Information"). You may control the collection of Geolocation Information through the user settings on your device. You may decline to allow us to collect such Geolocation Information, in which case we may not be able to provide certain services to you.

d) Information stored on your device

Depending on the particular app you use and only after you have agreed to such collection, we may collect certain information stored on your device, such as contact information, friends lists, login information (where necessary to allow us to communicate with other apps at your request), photos, videos, location information, or other digital content. Further details of the kinds of information we may collect are set out in the privacy notice of each individual app.

e) Information we collect from other sources, including our social media pages

We may collect personal information from users and visitors of other sites on which you have used the Services. We will do so in accordance with the terms of use and privacy policies of those sites and applicable law. This includes our social media pages on places like Facebook, Instagram, TikTok, YouTube, and X (formerly Twitter). For example, we may collect the information you shared on our social media pages through an application or form, which will have a link to this Privacy Policy. We may also receive personal information when you comment on our social media advertisements, post reviews about our products, or tag Get Joy in a public-facing social media post. Personal information may also be collected by the third-party social media sites that host our social media pages. These sites may provide aggregate information and analysis to us about visitors' use of our social media pages. This allows us to better understand and analyze our user growth, general demographic information about the users of these pages, and interaction with the content that we post. This Privacy Policy does not cover personal information collected by such third-party social media sites. f) Information we collect through third-party data and analytics providers

We use third-party data and analytics services (including Google Analytics) to evaluate your use of the Services, compile reports on activity, collect demographic data, enhance our data with other information about our users, analyze performance metrics, and collect and evaluate other information relating to the Services and mobile and internet usage. These third parties use cookies and other technologies to help analyze and provide us the data, and may also collect information regarding your use of other websites, apps, and online resources, and across your electronic devices. We may also receive information about you from our marketing partners, including data brokers, such as ad campaign information (e.g., the ads you click on) or the social media platforms you use. These third-party services may also provide us with information based on inferences to better understand our users. The information used by such services is usually at the aggregate level, but may contain identifiable personal information.

g) Tracking Data

We collect tracking data using first and third-party cookies, pixels, web server logs, web beacons, and similar data collection and tracking technologies on the Website, third party websites, apps and online services, and across your devices (such as IP address, browser type, ISP, platform type, device type). Third parties such as advertising networks and analytics providers may also collect information about your online activities over time and across different websites and devices when you access or use the Services.

h) Information obtained through inferences

Inferences are assumptions or extrapolations that have been drawn from any of the information identified above to create a profile about a consumer reflecting the consumer's preferences, characteristics, predispositions, behavior, attitudes, abilities, and aptitudes. We may obtain certain information through such extrapolations to personalize meal plan recommendations, identify products that may benefit your pet, and improve our Services.

3. Categories of Personal Information Collected (CCPA/CPRA Disclosure)

For purposes of California's privacy laws, the categories of personal information we have collected from California residents in the preceding twelve (12) months include:

  • Identifiers (name, email address, postal address, phone number, IP address, account login, unique online identifiers);
  • Customer records information (name, address, phone number, payment information);
  • Commercial information (purchase history, subscription details, product preferences);
  • Internet or network activity information (browsing history, search history, interactions with our Website and advertisements);
  • Geolocation data (general location derived from IP address; precise geolocation only with consent);
  • Inferences drawn from the above to create a profile reflecting your preferences and characteristics.

We do not collect sensitive personal information as defined by the CPRA (such as government identifiers, financial account credentials, precise geolocation, race, religion, health data, biometric data, or contents of mail/email/messages other than the Chat Assistant conversations described in Section 2(b)).

We do not sell personal information and we do not share personal information for cross-context behavioral advertising as those terms are defined under the CPRA.

4. How We Use Your Data

We use Your Data to provide the Services to you, and to operate our business. This includes:

  • Service-related usage: We use Your Data to provide and support the Services, such as communicating with you and other customers, managing user accounts, providing customer service (including through our AI Chat Assistant), informing you about our products and services, administering our rewards, referral, and promotional programs, processing your orders, managing your subscription, and maintaining our systems.
  • Subscription management: We use Your Data to process recurring subscription charges, send order and renewal confirmations, deliver legally required renewal reminders, notify you of material changes to your subscription, and respond to cancellation requests.
  • Analyzing and improving the Services: We may run calculations, aggregate, normalize, clean, enhance, and make derivative works of the information obtained about you in order to:
    • Understand and analyze usage trends and preferences;
    • Monitor and analyze the effectiveness of the Services;
    • Improve the Services and develop new products, services, features, and functionality;
    • Improve the accuracy and helpfulness of our AI Chat Assistant; and
    • Test the Services and our infrastructure to make sure the Services are working correctly.
  • Marketing: If you enter your contact information on the Website and opt in to receive electronic marketing communications from us, we may provide you with promotional materials that could be useful, relevant, valuable, or otherwise of interest to you, such as our newsletter, current promotions, and updates about services and products offered by us. We will not send you marketing emails if you have not signed up for this, and you can unsubscribe from receiving such emails at any time by clicking on the "unsubscribe" link at the bottom of all our marketing emails. You will continue to receive order confirmation emails, subscription notifications, and other transactional correspondence related to your account.
  • Advertising: Get Joy & Co., its business partners, and advertising/marketing companies may use Your Data to tailor, analyze, manage, report, and optimize advertising you see on the Services, and on other sites and apps that you access and/or use through your devices. By accessing and using the Services, you consent to the processing of Your Data for these purposes.
  • Legal and security: We may use Your Data to comply with legal obligations, protect against fraud, enforce our Terms of Service, and protect the rights, property, or safety of Get Joy & Co., our customers, or others.

5. How We Share Your Data

We may share, transfer, or disclose Your Data if you ask us to do so, as well as in the following circumstances. We will take reasonable measures to require that any party receiving any of your personal information from us undertakes to: (i) retain and use such information only for the purposes set out in this Privacy Policy; (ii) not disclose your personal information except with your consent, as permitted by law, or as permitted by this Privacy Policy; and (iii) generally protect the privacy of your personal information.

a) To assist us in running our business and providing services to you

We may employ other companies and individuals to perform functions on our behalf, such as website hosting, data analysis and enhancement, payment processing, subscription billing, order fulfillment, information technology and related infrastructure provision, customer service (including our AI Chat Assistant), email and SMS delivery, and shipping. These service providers include, but are not limited to:

  • Shopify (e-commerce platform and checkout);
  • Skio (subscription billing and management);
  • Klaviyo (email and SMS marketing and transactional messaging);
  • Zendesk (customer service ticketing);
  • AI Chat Assistant provider(s) (automated customer support);
  • Payment processors (Stripe, Shop Pay, PayPal, Google Pay, Meta Pay);
  • Shipping carriers and logistics partners.

These companies will have access to Your Data only as necessary to perform their functions and to the extent permitted by law.

b) To improve your shopping experience

We may share Your Data to help you quickly find products, services, or information, customize your shopping experience, improve our services to you, communicate with you about your pet's needs, create website content most relevant to you, and to alert you to product upgrades, special offers, updated information, and other new services from Get Joy & Co.

c) To administer our rewards, referral, and promotional programs

We may share Your Data with third-party sponsors of sweepstakes, contests, and similar promotions in order to administer these programs.

d) To better understand and serve our customers

In an ongoing effort to better understand our users and our Services, we might analyze Your Data in aggregate form in order to operate, maintain, manage, and improve the Services. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes.

e) For advertising and marketing purposes

We may share information about your activity in connection with your use of the Services with third-party advertising and remarketing partners to serve advertisements on our behalf across the internet. These entities may use cookies, web beacons, and other technologies to collect information about your use of the Websites and other sites, including your IP address, web browser, pages viewed, time spent on pages, links clicked, and conversion information. We do not sell personal information for monetary consideration and we do not share personal information for cross-context behavioral advertising as those terms are defined under the CPRA. However, our use of advertising cookies and similar technologies may be considered "sharing" under certain other state privacy laws. To opt out of such sharing, please see Section 10 (Your Privacy Rights).

f) As part of the sale or other transfer of our business

As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, investment, or similar corporate event, Your Data may be part of the transferred assets.

g) For legal purposes

To the extent permitted by law, we may also disclose Your Data when required by law, court order, or other government or law enforcement authority or regulatory agency, or whenever we believe that disclosing such information is necessary or advisable to protect the rights, property, or safety of Get Joy & Co. or others.

h) Sharing in chat rooms and bulletin boards

Any information you submit or post to chat rooms or bulletin boards associated with this Website will be publicly available and not private. You should not have any expectation of privacy for this information.

6. Data Retention

We retain Your Data for as long as necessary to provide the Services, fulfill the purposes outlined in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Specifically:

  • Account information: Retained while your account is active and for a reasonable period thereafter for legitimate business purposes.
  • Subscription consent records: Retained for at least three (3) years, or one (1) year after subscription termination (whichever is longer), as required by California's Automatic Renewal Law.
  • Transaction records: Retained for seven (7) years for tax, accounting, and audit purposes.
  • AI Chat Assistant conversation logs: Retained for up to twelve (12) months, after which personally identifiable information is deleted or de-identified.
  • Marketing communications data: Retained until you opt out or request deletion.

When retention is no longer required, we securely delete or de-identify the information.

7. Children's Privacy

Get Joy & Co. takes children's privacy seriously. Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 13, please do not give us any personal information. If you are between 13 and 17, you may use our Site only with the involvement and consent of a parent or legal guardian, and you may not enter into a subscription agreement. We encourage parents and legal guardians to monitor their children's internet usage and to help enforce our Privacy Policy by instructing their children to never provide us personal information without their permission. If you have reason to believe that a child under the age of 13 has provided personal information to us, please contact us at cares@getjoyfood.com, and we will promptly take steps to delete such information and terminate the child's account.

8. External Websites and Payment Service Providers

The Services may contain links to third-party websites. Get Joy & Co. has no control over the privacy practices or the content of any of our business partners, advertisers, sponsors, or other websites to which we provide links. As such, we are not responsible for the content or the privacy policies of those third-party websites. You should check the applicable third-party privacy policy and terms of use when visiting any other websites.

a) Account Information

If you wish to deactivate your account, please email us at cares@getjoyfood.com, but note we may continue to store information about you as required by law or for legitimate business purposes. We also will continue to use aggregated information as part of any studies or analyses.

b) Cookies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of the Website.

c) Promotional Communications

You may opt out of receiving promotional communications from us by following the unsubscribe instructions in those communications or by emailing us at cares@getjoyfood.com. Please note that you cannot opt out of receiving transactional emails related to your orders, your subscription, or your account, including legally required subscription renewal notices.

d) California Residents — CCPA/CPRA Rights

  • Right to Limit Use of Sensitive Personal Information: We do not collect or process sensitive personal information for purposes that would require this right to apply.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

We may extend this period by an additional 45 days where reasonably necessary, in which case we will notify you of the extension and the reason for it.

You may also designate an authorized agent to make a request on your behalf. We will require the agent to provide written authorization from you and may require you to verify your identity directly with us.

e) Pursuant to California's "Shine the Light" Law

California residents have the right to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes, including the names and addresses of those third parties and examples of the types of services or products marketed by those third parties. f) Connecticut, Colorado, Virginia, Utah, Texas, Oregon, and Other State Residents

If you are a resident of Connecticut, Colorado, Virginia, Utah, Texas, Oregon, or another U.S. state that grants consumer privacy rights, you may have similar rights to those described above for California residents, including the right to access, correct, delete, and opt out of certain processing of your personal information. g) Nevada Residents

If you are a resident of Nevada, you have the right to opt out of the sale of personal information to third parties. You can exercise this right by contacting us at cares@getjoyfood.com with the subject line "Nevada Do Not Sell Request" and providing us with your name and the email address associated with your account.

11. Do Not Track

Currently, various browsers offer a "Do Not Track" option, but there is no industry standard for how commercial websites should respond. At this time, we do not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser "Do Not Track" settings and/or signals. We do, however, honor the Global Privacy Control (GPC) signal where required by applicable law, which allows you to communicate your privacy preferences to us automatically.

12. Notice to Non-U.S. Residents

The Site and the Services are hosted in and provided from the United States and are intended for visitors located within the United States.

If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States where the privacy laws may not be as protective as those in your country of origin.
